A Comparative Study of the Canada Flexible and Us Rigid Federalism

ABSTRACT

Distribution of powers between Central and Regional government has been a subject of enduring debate among practitioners and scholars. Federal system is a subset of constitutional system. Our examination in constitutional federalism will focus on relationship between federalist structure and the exercise of political power, the role of federal structures in defining, or evolving, the identity and even the boundaries between the governments. In the modern period, the constitution of the United States of America of 1787 is treated as the first experiment in establishing a federal system of government. The primary aim in regard of comparative system is to harmonise the two major system of law for the sake of better understanding of the problems of one system(country) in order to find a solution thereof, from the study of a competing system prevailing in another country.
