Capital Punishment in India: A Critical Study

ABSTRACT Capital punishment refers to the execution of an individual condemned by the state for the commission of a crime. The effectiveness of this penalty is a subject of intense debate in modern society. Abolitionists hold the ethical position that capital punishment is immoral due to its infringement upon human rights and the potential for sentencing bias. The advocates of capital punishment cite the "eye-to-eye approach" and the "deterrent theory" as the primary justifications for their stance. Nevertheless, a number of judicial pronouncements in India have underscored the "rarest of the rare" circumstances in which this form of punishment should be employed.
