Critical Analysis of Mandatory Practice at Bar for the Judicial Examination

ABSTRACT

In every field, reforms play a very vital and crucial role. Reforms are necessary for the development of any field. The legal profession in itself is very dynamic and thus keeps on changing. Parliament of India, Supreme Court of India, Bar Council of India and Law Commission of India are some bodies that propose and ensures reforms in the field of law. The Bar Council of India (BCI) was established to deal with the complications of the legal profession. The mandate of legal studies, their examination and institutionare governed by BCI. Therefore, BCI is vested with the responsibility of developing and reforming the legal profession.

Sometimes it is possible that certain reforms proposed by BCI result oppressing and unwarranted as recently, BCI intended to step towards a mandatory practice at the bar for three years for a law graduate as a qualification for appearance in the judicial examinations. This paper discusses the extent of justification of this notification of BCI.
