Dilemmas, Judicial Interpretation and the Balancing Act Between National Security and Civil Liberties in the Digital Age

ABSTRACT There have been historical conflicts between civil liberties and the Government in various forms. Prominent examples are Glorious revolution in England in 1688, War of Independence in USA 1771, French Revolution 1789, Civil Rights Movement in USA in 1950s and 1960s, etc. Recently, in this digital age, the friction between the national security and civil liberties has intensified resulting in rise of challenges before law makers and judiciary. Governments worldwide employ digital surveillance, data collection, and cyber security measures to safeguard national interests, often clashing with individual rights such as privacy, free speech, and due process. The conflict was outshining during Aadhar card bill, enactment of National Security Act, etc.
