Enforcement of Employees Compensation Act, 1923 with Special Reference to Hyderabad District

ABSTRACT In order to determine the enforcement of compensation in the State of Telangana with particular reference to the Hyderabad District, an empirical study on the application of the Employee’s Compensation Act, 1923, was done. The Employees Compensation Act, 1923 fundamental flaw is that it places the employer’s whole compensation burden on him but does not oblige him to have liability insurance. The employer cannot avoid his responsibility if he insures his liability under the Act. Employees/workmen who were contacted to assess the effectiveness of the Employee’s Compensation Act, 1923, were typically uninformed of its existence. This lack of knowledge on the part of the workers/employees enables the employers to simply avoid paying compensation. All the regular employees of the organization’s are subject to the terms of the Employees Compensation Act, 1923. The compensation was paid by the surviving family members of a deceased worker at the rate specified by the Act. The current social security system is hampered by a plethora of regulations, insufficient coverage, a lack of policy, and a lack of effective implementation mechanisms. An empirical study was conducted to find out the enforcement of enforcement of employees compensation act, 1923 with special reference to Hyderabad district.
