Examination of Deterrent Theory of Punishment in India in the Light of Developments in Criminal Justice

ABSTRACT The death penalty is often described as barbaric, undemocratic, anti-life, and irresponsible, but it remains legal1 . The topic of capital punishment has always been divisive. On one hand, it is irreversible, prone to errors, and applied inconsistently, making it difficult to determine if the death penalty truly serves the purpose of justice2 . On the other hand, the claimed penological purposes of the death penalty cannot be disproven or proven definitively.
