Examining Family Ties and Decriminalization of Adultery

ABSTRACT : Adultery means when a person is engaged in a sexual intercourse with a married person, but they are not their husband or wife. Such sexual intercourse shall be with the consent of both the parties against the consent of the spouse of such married person. It shall be tried in the criminal courts as it is a crime against the spouse of such married person and a crime against the institution of marriage. Family is the smallest and basic unit of the society, and matters like adulty which goes against this basic unit is an offence against the society in general, and make people lose faith in the institution of marriage. Many people are affected bythis act, specially the dependents of this married person, like their children, and old parents orin-laws, and also the child born out of the sexual intercourse of the adulterers. At last, cases ofadultery bring the mistrust of the general people in the institution of marriage.
