International Law and its Weakness with Special Demonstration through some of the ICJ Cases

ABSTRACT The following article has three main proponents - the umbrella term definition of International law, how weak the International Law is and some of the ICJ cases which conclude its ineffectiveness. In this article, the thoughts of various scholars and jurists such as Hugo Grotius, Jeremy Bentham, Prof. L. Oppenheim, Sir Robert Jennings, Georg Schwarzenberger, Sir Fredrick Pollock, Chief Justice John Marshall, J. Grey, John Austin, Thomas Hobbes and Samuel Pufendorf about International Law are mentioned. The legalities as per The UN charter and The ICJ Statute also find their mention. However, this article is majorly concerned with and revolves around some of the ICJ cases like The Corfu Channel Case of 1949, Military and Paramilitary activities in and against Nicaragua case of 1986 ,etc. which deduces how International Law has a weak enforceable approach and how the absence of robust enforcement mechanisms weakens the impact of international obligations. At the closing after the consideration of all the facts, the article also provides some insights upon the steps that could be taken to better the International law.
