Issue of Digital Data Privacy on Mobile Phone Applications

ABSTRACT As India has the second largest internet user base in the world, the risk of the privacy infringement associated with the internet is also large. Right to privacy is a fundamental right, which even though not specifically mentioned in our Constitution but Article 21 of the Indian Constitution deals with it. On 24 August, 2017 the Supreme Court of India has passed the landmark judgment and declared Right to Privacy as afundamentalright which is protected by the Indian Constitution. Recently, in August 2023, the Indian Parliament has passed the first law on Data Privacy i.e. The Digital Personal Data Protection Act, 2023. In context of India, we have a population of 1.4 billion so the usage of mobile phones is also huge. Whenever, any individual downloads an application which is now become necessary in case of many aspects of day-to-day life, it asks for various permissions which are not even related to the working of that application. This is straightforward infringement of the Right to Privacy as it is not clear that why these application companies ask unnecessarypermissions and what they exactly do with the information. Data protection is a very serious issue as the whole world is shifting to the using ofsmart phoneand artificial intelligence. This is a fraud and violation of individual’s privacy. There should be strict limitation on all these applicationsand they should be allowed to ask only those permission which is related to their services and not beyond that. The researcher has undertaken this topic to study about the right to privacyof the individual in relation to the unnecessary permission taken from the user while using that application andwhat can be done by any user while accessing the application on their mobile phones.
