Judicial Control of the Administrative Action on Delegated Legislation: A Critical Analysis

ABSTRACT

00The research paper  will try to tends to study the concept of the Delegated legislation and historical growth of the concept to find out the reasons that ushered the growth of the Delegated Legislation. The project revolves around the comparative framework to find out the lacunae within our system if any after studying the concept around the countries. The objective of the research paper is to make an in-depth study of the concept of the delegated legislation and to study the reasons that propelled the growth of the concept of Administrative Law and to study the basis of the classification of the Delegated Legislation.

 Further, the objective is to study the comparative framework of the concept of Delegated Legislation in England, USA, and India. Further, the objective is to analyze the concept of the Excessive Delegation and to study the basis on which delegation would become Excessive.

Further, the objective is to analyze the concept of the sub delegation and to what extent it is acceptable. Further, the projects  aims to analyze the control mechanism of Administrative Law and to study the doctrine of Ultra vires. Further, the objective is to analyze the implied restriction on the delegated Legislation.
