Judicial Review in the Indian Constitution: Safeguarding Rights, Balancing Powers, and Shaping Democracy

ABSTRACT The Indian Constitution, modelled after the U.S. Constitution, incorporates robust provisions for judicial review, allocating authority between the states and the enter. This research explains the impact of judicial review on the Indian legal system, especially Articles 13, 32, 131–136, 143, 226, 145, 246, 251, 254, and 372.386. These articles give the courts the power to review and throw out laws that violate basic rights or constitutional principles. Articles 32, 142, and 141 give the Supreme Court the clear power to review laws that were in place before the Constitution. This shows how important judicial review is for protecting constitutional values.
