Literature Review on Law Construction and Scrutiny: Theoretical and Design Framework, Difference of English Common Law and French

ABSTRACT English common law and French civil law systems have played a significant role in the global legal sphere. Although both systems originated in Europe, they have substantial differences in their theoretical and design frameworks that shape legal proceedings and the construction of the law. In their application in a post-colonial context, the results vary. To further analyze any of their applications, one must attain a deep understanding of their structure and development-provided a historical and cultural contextualization of the present results. This literature review aims to explore the distinct characteristics of these systems and provides an overview of scholarly contributions regarding law construction and scrutiny in common and civil law jurisdictions.
