Restorative Justice Practices in India: A Modern and Unique Way of Criminal Justice System

ABSTRACT This new way of responding to harm is called restorative justice, and it offers a paradigmatic alternative to the traditional retributive system. Restorative justice practices offer a different way of dealing with crime and conflict through the lens of repairing harm, engaging in dialogue between parties involved and impacted as well as all stakeholders. This paper reviews the definition and content of restorative justice in general, with a special focus on India. The article assesses the present state of restorative justice in India, provides successful case studies, scopes out challenges and pathways for a deeper operationalization of restorative justice within the larger context of Indian criminal system.
