The Study of Legal Aid under Indian Constitution
Author Name : Adv Charusheela J. Nalhe
ABSTRACT
Introduction: Legal aid can be interpreted as providing low-income people with free legal representation in any judicial proceedings before a court, tribunal, or other authority. It strives to offer free legal assistance to those in need who are unable to exercise their legal rights. Legal aid, according to Justice P.N. Bhagwati, refers to a social structure that makes the systems of administration of justice easily reachable and accessible to people who need to use them to enforce the legal rights that have been granted to them.
Objectives: The purpose of this paper is to investigate the constitutional provisions relating to legal aid, the bodies covered by the Act and their hierarchies, and the beneficial effects of free legal aid provided by the judiciary in India.
Methodology: In order to accomplish these goals, the researcher used a doctrinal format, and the author consulted secondary sources when doing the research study.
Conclusion: Legal aid refers to free legal services that are provided to further the welfare of the public. Numerous initiatives in this regard have been made in India, such as the implementation of ‘Lok Adalat’. A defendant has the right to request legal help if he cannot afford it, as stated in some Indian constitutional articles.
