Corporate Liability for Human Rights Violation

ABSTRACT Corporations play an important role in economic development in today’s globalized world. However, with this expanded role comes an increased demand for responsibility, particularly when corporations violate human rights. Over the last few decades, India has experienced substantial economic expansion, which has frequently been linked to corporate operations. Concurrently, concerns have been raised about the impact of these operations on human rights, particularly labor rights, environmental issues, and social justice. This article discusses the judicial decisions in India that have changed the discussion on corporate responsibility for human rights violations, such as Union Carbide Corporation vs. Union of India, which involved the Bhopal Gas tragedy is studied to demonstrate how Indian courts have handled this incident of corporate negligence and human rights breaches. The analysis identifies several issues and shortcomings in the current legal system.
