Essential Religious Practice Test in India: A Critical Analysis

ABSTRACT The present study focuses on the critical evaluation of essential religious practice tests in India. The unique brand of Indian secularism emphasizes Sarva Dharma Sambhav i.e equal respect for all religions. To ensure pluralism in Indian society Article 25-28 of the Indian constitution provides freedom of religion to its citizen. But does it also mean that they have the freedom to profess and practice superstitious beliefs or how much power does the state possess to intervene in the religious affairs of denominations apex court of India evolved essential religious practice test i.e only essential religious practices are entitled to constitutional protection? However, the over-enthusiastic use of this test poses a threat to the fabric of plural society and reduces the scope for religious dissent by enforcing a majoritarian view. Also, questions are raised over the competence and authority of courts to delve into the ecclesiastical domain.
