“Evolution of the Judicial Independence- Indian Overview”

ABSTRACT
This paper deals with the historical development of the Indian Judicial system from its ancient times to date. The Indian judicial System has mostly evolved through different stages that is from the ancient period which included the Vedic, medieval, British period, and after independence until date. The administration of justice was not formal, and it was applied differently based on caste, religion especially Hindus and Muslims, the British and latercame to be provided in the constitutional provisions of India. There existed Kings who were above the law, for the king could not be punished in the Court of the law. Later, this came to pass when Kings were made liable in the eyes of the law. The said Kings used personal laws to award punishment while administering justice within their jurisdictions. In the Medieval period, Muslim Rulers contributed lot in changing the system of administering justice through the rule of Sultan in Delhi and Mughal Period who strictly followed the doctrines of Quran and the dictates of prophet Mohammed. This paper intends to unveil the various stages that the Judiciary of India has undergone from its onset to present.
