Author Name : Shikha Bhatnagar, Dr. Sarika Tyagi
ABSTRACT
Live-in relationship is a such type of living arrangement where two adults of different sex or of same sex agrees to live together under a same roof of same house similar to that of husband and wife without performing any rituals of marriage as per their personal laws . Even after the Years of independence has passed on , lot of discrimination is still seen in the Indian society that people consider it wrong or sin or as a taboo or a social stigma or black spot on the society if a young generation enters into live in relationship without any legal marriage and these people specially of rural areas does not provide social acceptance to such kind of relations because they considered such relations illegal and opposed to public policy but unfortunately our Indian legislature has declared the live in relationship as legal in the eyes of Law in furtherance to this various judgements have been made out by the honourable supreme court and the respective state High courts from time to time and according to the facts and circumstances of the cases decisions are awarded by these courts.
Therefore, it can be said the its completely a discretion of the judges sitting on the bench who ultimately becomes the sole decider of whether the court will grant protection and sanction to a couple living in a live-in relationship or not.
Majority of the people are still against the western culture of Live in Relationship which has stepped into the shoes of Indian society because in this era of advancements and developments people give more importance and social acceptance to those relations which are created between a male and female through the institution of Marriage . That’s why human beings treat live in relationship as social stigma .
